Municipal Servicing Allocation By-law

In response to Bill 185, the Town developed a Municipal Servicing Allocation By-law under the authority of the Municipal Act to establish a clear and transparent process for allocating municipal servicing capacity in support of development applications.

Policy Overview

The Municipal Servicing Allocation By-law 2026-051-RE was passed by Council on June 3, 2026, following consideration of staff report DS-024-26 and is now in force and effect.

The policy establishes timelines, processes, and tracking to align servicing allocation decisions with infrastructure capacity and development readiness in efforts to support housing delivery and development growth.

The Municipal Water Supply and Sewage Allocation By-law gives the Town the authority to allocate available water and wastewater servicing capacity to eligible development applications based on a “use it or lose it” mechanism. If servicing allocation is not utilized in a timely manner, it shall be forfeited by the applicant and given to another application.

This By-law and process only apply to developments within the community of Stouffville including:

  • Consent Applications
  • Development with 4 to 10 Residential Units
  • Draft Plans of Subdivisions or Condominiums

This By-law and process does not apply to the following situations:

  • Lands, buildings, and/or structures that are connected to private water and/or sewage services
  • Non-Residential building renovations or accessory structures that do not increase demand for municipal water supply and sewage capacity
  • Residential building renovations or accessory structures that do not increase demand for municipal water supply and sewage capacity

Application Process

Step 1: Submission of CARR Form & Early Notification

To begin the process, you must submit a completed Capacity Availability Review Request (CARR) Form by email or in-person at Town Hall, 111 Sandiford Drive, Stouffville ON, L4A O8Z

You must also submit a Planning Act or Non-Planning Act Application.

The By-law implements a “use it or lose it” approach, ensuring that municipal water and wastewater servicing capacity is allocated to development projects that are ready to move forward to construction.

If the Allocation is not used within the established period, it will expire and be revoked. Once revoked, the Allocation will no longer be reserved for the development proposal and will be reassigned to the next eligible applicant.

Reserved Allocation

Once an application has been Conditionally Approved, the development proposal will be issued an Allocation Memo to indicate the Allocation Reservation. During this period, development proposals must clear conditions to the satisfaction of the Town within a specified period. Expiration dates are based on application type.

  • Site Plan Agreement Application – 18 months
  • Draft Plan of Subdivision or Condominium – 36 months
  • Consent Application – 24 months

Allocation Confirmed

Once all conditions of approval have been met, Allocation will be confirmed. At this stage, allocation is still conditional, and Applicants have 12 months to obtain a Building Permit, applicable to all application types.

If an Applicant fails to obtain a Building Permit prior to the expiry date, the Allocation will be revoked. The automatic revocation of the Allocation shall take effect immediately.

Written notice will not be provided to the Proponent by the Town or the Commissioner if Allocation is revoked.

The transfer of allocation is not permitted. The Applicant will be required to re-submit a CARR Form along with any applicable fees.

Requesting an Extension:

The Applicant must submit a written extension request a minimum of 90 days prior to expiry date noted in Allocation Memo. A maximum of 2 extension requests shall be permitted for a single development. The request shall include:

  • An explanation for the request for extension
  • Any documentation demonstrating progress towards issuance of a Building Permit and/or completion of applicable conditions
  • Applicable fees as set out in the Town’s Fees and Charges By-law

1st Request – 12 months

Extension may be granted for up to twelve (12) months for “Reservation of Allocation” or “Allocation of municipal water supply and sewage capacity” by the Commissioner. Extension approval is not guaranteed.

2nd Request – 6 months

Extension may be granted for an additional six (6) months for “Reservation of Allocation” or “Allocation of municipal water supply and sewage capacity” by the Commissioner. Extension approval is not guaranteed.
